Flere EU-land har like lite kontroll med kriminelle og mentalt syke som med vanlige borgere. Det gjør at mentalt syke kan utskrive seg selv fra sykehus og dra til et annet land og begå forbrytelser. To tilfeller illustrerer problemet, som er en risiko for intetanende mennesker i andre land.

Nigel og Sue Varian mistet sin sønn Chris (32) i 2010. Han ble drept og halshogget av en kosovoalbansk ansatt. Chris Varian var sjef på en restaurant på en golfklubb i Camebridge. Han hadde fått en medarbeider som kom fra Sverige. Det han ikke visste var at Jonathan Halil Warg Limani var blitt arrestert for grovt overfall og forsøk på drap. Likevel var han løslatt i påvente av at saken skulle komme opp. Intet hindret Limami i å forlate Sverige og dra til Storbritannia. Der drepte han Chris Varian en måned senere.

Foreldrene har villet vite sannheten. De har forstått at det ikke er noe i EUs omfattende regelverk som sørger for at mentalt syke blir holdt tilbake, selv ikke når de begår alvorlige forbrytelser. De mener deres sønn ville vært i live hvis slike regler fantes.

De har forsøkt å få ut informasjon fra Sverige, men svenske myndigheter har ikke villet samarbeide.

Mr Varian’s parents, Nigel and Sue, have described how their attempts to find answers about how Limani was free to kill their son have been blocked at every turn by the Swedish authorities.

They have been unable to obtain a full investigation into how Limani, who held dual Albanian-Swedish nationality, was free to travel.

The Varian family have asked the Government to press for changes to EU free movement rules, which they believe contributed to Chris’ death.

They have handed a summary of the case to a Home Office review – which closes on Monday.

It says they believe their son would have been alive today if a system had been in place to restrict the movement of offenders with dangerous psychiatric conditions.

Nigel Varian, 66, who worked in the film industry who now runs a bed and breakfast near La Rochelle, western France, said: “Society needs to demand that these safety issues are tightened up.

“When some of these offenders have psychiatric conditions that can make them extremely violent, it is irresponsible to leave them in the community.

“It is our view that the Swedish police and Swedish psychiatric services were negligent in their duties.

“We are convinced that our son would still be alive today if the Swedish police had taken appropriate action. we would like it to be investigated, but the authorities have repeatedly refused our requests.”

Limani, 34, admitted manslaughter on the grounds of diminished responsibility and was jailed for life, with a direction that he should serve at least 19 years, in March last year.

I november i fjor skjedde noe lignende. Da ble en svaksynt britisk professor drept utenfor sitt hjem av en tysk ungdom, også han paranoid schizofren. Tim Sommers hadde allerede rukket å drepe på sitt hjemsted utenfor Frankfurt. Han ble innlagt på psykiatrisk sykehus, men skrev seg selv ut etter fire dager.

 

Disturbing aspects of the case were repeated last November with another blunder by police in another EU country, leading to the murder of a blind academic on his own doorstep by a German teenager.

Tim Sommer, 18, beat Dr Douglas Hutchison, 60, to death outside his home in London less than three weeks after killing a 47 year-old woman in his home town, south of Frankfurt.

German police only issued a European Arrest Warrant weeks after they realised Sommer had left the country – and after he had entered Britain, meaning he could not have been stopped at the border and arrested.

In the case of Sommer, the son of prominent plastic surgeons, he admitted manslaughter on the grounds of diminished responsibility last month.

Sommer stalked partially-sighted Dr Hutchison, who walked with a white cane, to his home, where he jumped on his victim’s head with such violence that his skull was “crushed to smithereens”, his trial heard.

Sommer came to Britain a few days before the killing, and 18 days after he allegedly killed Fatma Bezohra in his hometown of Darmstadt, Germany, the court was told.

She was beaten to death with a set of ladders and a chair.

Edward Brown QC, prosecuting, revealed Sommer would never have arrived in Britain had he not been allowed to discharge himself from a Berlin psychiatric hospital he had been placed in by police just four days after his first alleged murder.

Before authorities connected him to the crime, he fled to Britain and killed Dr Hutchison 10 days later, the court heard.

Ms Bezohra was found with fatal head injuries and police released an e-fit of the attacker, issued an all borders alert and offered a reward for information leading to his arrest.

However, their actions were too late, because the suspect was already in Britain where he would soon kill again.

 

De to tilfellene er ikke identiske. Tysk politi visste ikke at Sommer var drapsmann da han ble innlagt. Men spørsmålet er likevel: skal paranoid schizofrene  kunne skrive seg selv ut? Skal de kunne reise til et annet land der ingen kjenner dere sykehistorie?

Den konservative parlamentarikeren Dominic Raab synes det er merkelig at EU som har 135 forskjellige lover om politi og forbrytelser, men ingen som dekker psykisk farlige mennesker.

 

Dominic Raab, a Conservative MP, said the cases exposed dangerous failings in the way police in other EU countries handle violent suspects.

“We have over 135 EU crime and policing laws, but that has not stopped dangerous fugitives waltzing into Britain, because foreign police aren’t flagging the individuals with their border agencies,” he said.
